TOPLABSBAZAAR.COM Technologies Private Limited (“TOPLABSBAZAAR.COM”) owns and operates the website www.toplabsbazaar.com and the mobile application “TOPLABSBAZAAR.COM” (collectively referred to as the “Website & Application”).

By accessing or using our Website & Application, you agree to be bound by these Terms and our Privacy Policy.

1. Nature and Applicability of Terms

These Terms constitute a legally binding agreement between you and TOPLABSBAZAAR.COM. The Agreement applies to:

• Medical practitioners or healthcare providers listed on the platform (“Practitioners”)
• Patients or representatives booking services (“End-Users”)
• Any other visitor or user of the platform

Services may change at TOPLABSBAZAAR.COM’s sole discretion. Continued use of the Website & Application constitutes acceptance of updated Terms.

2. Conditions of Use

You must be 18 years or older to use the Services. By using the platform, you represent that you have legal capacity to enter into this Agreement.

3. User Accounts & Privacy

• Users must provide accurate and complete information.
• Users are responsible for maintaining confidentiality of login credentials.
• TOPLABSBAZAAR.COM may suspend accounts providing false or misleading information.
• Personal and sensitive data is handled in accordance with our Privacy Policy.

4. Listing & Information Disclaimer

Information regarding practitioners is collected and displayed for user convenience. While reasonable efforts are made to maintain accuracy, TOPLABSBAZAAR.COM does not guarantee completeness or accuracy.

5. Appointment Booking

• TOPLABSBAZAAR.COM facilitates booking but does not provide medical advice.
• We are not liable for practitioner cancellations, rescheduling, or treatment outcomes.
• Total aggregate liability shall not exceed INR 1000.

6. Health Records & Prescription Access

• Records are created based on user consent.
• Practitioners are solely responsible for medical records content.
• Users must safeguard login credentials.
• Deletion requests may be sent to privacy@toplabsbazaar.com.

7. Practitioner Terms

• Profiles may be moderated or removed at discretion.
• Practitioners warrant compliance with applicable laws.
• Profile ownership remains with TOPLABSBAZAAR.COM.

8. Prohibited Conduct

Users shall not upload or share content that is unlawful, defamatory, harmful, infringing, or violates Indian laws. Any violation may result in immediate termination.

9. Termination

TOPLABSBAZAAR.COM may suspend or terminate access without prior notice in cases of breach, fraud, illegal activity, or violation of these Terms.

10. Limitation of Liability

TOPLABSBAZAAR.COM and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Services.

11. Applicable Law & Dispute Resolution

This Agreement is governed by the laws of India. Any disputes shall be subject to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Mumbai, and courts at Mumbai shall have exclusive jurisdiction.
